Cemex wins antidumping battle, Peru

On November 18, Peru’s National Institute for the Defense of Competition and Intellectual Property Protection (INDECOPI) issued an order revoking the request to apply anti-dumping duties on imports of white cement by Cemex of Mexico, requested by Compañía Minera de Agregados Calcáreos S.A. (COMACSA).


The resolution issued by the Indecopi Tribunal notes that imports by Cemex between 2003 and 2006 did not cause injury to domestic production, and COMACSA’s economic indicators were positive, both in production, sales, cement deliveries, increased use of capacity, among others.


Cemex legal advisers indicated that for the first half of December they applied to  Customs to seek reimbursement of antidumping duties applied to imports of white cement.


Ivo Gagliuffi, partner at Lazo, Romagna and Gagliuffi and Cemex lawyer, said once declared unfounded the claim made by COMACSA, annulling the anti-dumping measures affecting imports of white cement (US$ 62/t).
